1. Toepasselijkheid
Deze voorwaarden gelden voor onze dienstverlening aan personen die een huurwoning zoeken ("u"). Wij sturen u deze voorwaarden toe voordat de overeenkomst tot stand komt, zodat u ze kunt opslaan en teruglezen. Ze staan ook op onze website.
2. Onze dienst
Wij helpen u bij het zoeken naar een huurwoning in Rotterdam en omgeving. Dat bestaat uit het volgen van het aanbod, het voorstellen van passende woningen, het plannen van bezichtigingen en het begeleiden van uw aanvraag tot en met de oplevering.
Wij werken uitsluitend in opdracht van u als huurder. Wij hebben geen opdracht van de verhuurder en ontvangen geen vergoeding van de verhuurder of diens makelaar.
3. Totstandkoming van de overeenkomst
Het invullen van het zoekprofiel op onze website is vrijblijvend en leidt niet tot een overeenkomst. Een overeenkomst komt tot stand wanneer u ons schriftelijk of per e-mail opdracht geeft, nadat wij u de dienst, het tarief en deze voorwaarden hebben gestuurd. U zorgt dat de gegevens die u doorgeeft juist en volledig zijn.
4. Prijs
De vergoeding voor onze dienst en het moment waarop u die betaalt, staan in de overeenkomst. Wij noemen de prijs altijd vóór u akkoord gaat, inclusief btw en alle andere kosten. U betaalt ons alleen wat u vooraf met ons heeft afgesproken. Wij brengen u geen bemiddelingskosten in rekening voor een woning waarvoor wij ook voor de verhuurder werken. Kosten die de wet verbiedt, rekenen wij niet.
5. Inspanning, geen garantie
Wij doen ons best om een passende woning voor u te vinden, maar kunnen niet garanderen dat dat lukt of binnen welke tijd. De verhuurder beslist wie de woning huurt. Wij kunnen een huurovereenkomst niet afdwingen.
6. Uw medewerking
U geeft ons de informatie die nodig is, zoals uw wensen, budget en inkomen, en reageert tijdig op voorstellen. Doet u dat niet, dan kunnen wij de dienst opschorten.
7. Informatie over woningen
Wij baseren ons op informatie van verhuurders en andere bronnen en controleren die zorgvuldig. Prijzen en beschikbaarheid kunnen veranderen zonder dat wij dat weten.
8. Herroepingsrecht (bedenktijd)
Bent u consument en heeft u de overeenkomst online of per e-mail gesloten, dan kunt u de overeenkomst binnen 14 dagen zonder opgave van reden herroepen. De termijn verstrijkt 14 dagen na de dag waarop de overeenkomst is gesloten.
Om te herroepen, laat u ons met een ondubbelzinnige verklaring weten dat u de overeenkomst herroept, bijvoorbeeld per e-mail naar info@rosemakelaars.nl. U kunt hiervoor het modelformulier onderaan deze pagina gebruiken, maar dat hoeft niet. Wij bevestigen uw herroeping per e-mail.
Wij betalen alles wat u ons al betaalde terug, zonder onnodige vertraging en uiterlijk binnen 14 dagen nadat wij uw herroeping hebben ontvangen, op dezelfde manier als u betaalde.
Wilt u dat wij al beginnen tijdens de bedenktijd, dan vragen wij u daar uitdrukkelijk om. Herroept u daarna, dan betaalt u ons een evenredig deel voor wat wij tot dat moment al voor u deden. Heeft u uitdrukkelijk ingestemd met het begin van de dienst en erkend dat u uw herroepingsrecht verliest zodra wij de dienst volledig hebben uitgevoerd, dan vervalt uw herroepingsrecht zodra de dienst volledig is uitgevoerd.
9. Opzegging
U kunt de overeenkomst op ieder moment per e-mail opzeggen. Bedragen die u op grond van de overeenkomst al verschuldigd bent voor wat wij al hebben gedaan, blijven verschuldigd. Wij nemen geen stilzwijgende verlenging op.
10. Betaling
U betaalt een factuur binnen [14] dagen. Betaalt u niet op tijd, dan sturen wij u een aanmaning. U krijgt daarna minimaal 14 dagen om alsnog te betalen. Pas daarna kunnen wij de wettelijke rente en de wettelijk toegestane incassokosten in rekening brengen.
11. Aansprakelijkheid
Wij zijn aansprakelijk voor schade die het gevolg is van een toerekenbare tekortkoming van ons, voor zover de wet dat bepaalt. Deze voorwaarden beperken uw wettelijke rechten als consument niet. Wij zijn niet aansprakelijk voor schade door onjuiste informatie die u of een verhuurder ons gaf, tenzij wij dat hadden moeten weten.
12. Privacy
Hoe wij met uw gegevens omgaan, leest u in onze privacyverklaring.
13. Klachten
Bent u niet tevreden, mail ons dan op info@rosemakelaars.nl. Wij bevestigen uw klacht en reageren binnen [14] dagen inhoudelijk. Komen wij er samen niet uit, dan kunt u een geschil voorleggen aan [geschillencommissie of branchevereniging waarbij u bent aangesloten, indien van toepassing] of aan de bevoegde rechter.
14. Toepasselijk recht en rechter
Op onze overeenkomst is Nederlands recht van toepassing. Dwingende consumentenbescherming van het land waar u woont blijft voor u gelden. Een geschil kunt u voorleggen aan de rechter die volgens de wet bevoegd is, waaronder de rechter in uw woonplaats.

1. Scope
These terms apply to our services for people looking for a rental home ("you"). We send you these terms before the agreement is concluded so you can save and reread them. They are also on our website.
2. Our service
We help you search for a rental home in Rotterdam and the surrounding area. This includes following the available listings, proposing suitable homes, scheduling viewings and supporting your application through to handover.
We work exclusively on your behalf as the tenant. We have no assignment from the landlord and receive no fee from the landlord or their agent.
3. Forming the agreement
Completing the search profile on our website is non-binding and does not create an agreement. An agreement is formed when you instruct us in writing or by email, after we have sent you the service description, the price and these terms. You make sure the information you give us is correct and complete.
4. Price
The fee for our service and when you pay it are stated in the agreement. We always state the price before you agree, including VAT and all other costs. You only pay what you agreed with us beforehand. We do not charge you intermediary fees for a home for which we also work for the landlord. We do not charge costs that the law prohibits.
5. Best efforts, no guarantee
We do our best to find a suitable home for you, but we cannot guarantee that we will succeed or how long it will take. The landlord decides who rents the home. We cannot force a rental agreement.
6. Your cooperation
You give us the information we need, such as your wishes, budget and income, and respond to proposals in good time. If you do not, we may suspend the service.
7. Information about homes
We rely on information from landlords and other sources and check it carefully. Prices and availability may change without our knowledge.
8. Right of withdrawal (cooling-off period)
If you are a consumer and concluded the agreement online or by email, you may withdraw from the agreement within 14 days without giving a reason. The period ends 14 days after the day the agreement was concluded.
To withdraw, tell us by a clear statement that you withdraw from the agreement, for example by email to info@rosemakelaars.nl. You can use the model form at the bottom of this page, but you do not have to. We confirm your withdrawal by email.
We refund everything you already paid us without undue delay and no later than 14 days after we receive your withdrawal, using the same payment method you used.
If you want us to start during the cooling-off period, we ask you to say so explicitly. If you then withdraw, you pay us a proportionate amount for what we have already done for you. If you explicitly agreed to the start of the service and acknowledged that you lose your right of withdrawal once we have fully performed the service, your right of withdrawal ends as soon as the service has been fully performed.
9. Cancellation
You can cancel the agreement at any time by email. Amounts you already owe under the agreement for what we have already done remain payable. We do not include automatic renewal.
10. Payment
You pay an invoice within [14] days. If you do not pay on time, we send you a reminder. You then have at least 14 days to pay. Only after that can we charge statutory interest and the collection costs the law allows.
11. Liability
We are liable for damage resulting from an attributable failure on our part, to the extent the law provides. These terms do not limit your statutory rights as a consumer. We are not liable for damage caused by incorrect information that you or a landlord gave us, unless we should have known.

13. Complaints
If you are not satisfied, email us at info@rosemakelaars.nl. We confirm your complaint and respond in substance within [14] days. If we cannot resolve it together, you can submit a dispute to [dispute committee or trade association you belong to, if applicable] or to the competent court.
14. Governing law and court
Dutch law applies to our agreement. Mandatory consumer protection in the country where you live continues to apply to you. You can bring a dispute before the court that has jurisdiction under the law, including the court where you live.
